Privacy Policy

Your privacy is important to us. This Privacy Policy explains how OZI Sleep (“we,” “us,” or “our”) collects, uses, shares, and protects information when you use the OZI Sleep Tracker and mobile application (collectively, the “Services”).

Information We Collect

Depending on the features you use, we may collect:

Account Information

  • Name, email address, phone number, date of birth, and account credentials
  • Household profile information for adults and children you add to your account

Device & Technical Information

  • Device model, operating system, app version, language, and time zone
  • WiFi and Bluetooth connection details, IP address, and crash logs
  • App usage information and interaction events

Health & Sleep Data

  • Sleep duration, sleep stages, movement, breathing rate, heart rate, heart rate variability, snoring, sleep efficiency, out-of-bed events, and alert history
  • Self-reported wellness inputs (mood, caffeine, exercise, etc.)

Support & Communications

  • Customer support messages, feedback, survey responses, and product reviews

Sensitive Personal Information

OZI Sleep collects health-related information including heart rate, heart rate variability, breathing rate, and sleep patterns. Under applicable laws (including the California Privacy Rights Act), this may be considered sensitive personal information. We use this data solely to provide the Services and generate sleep insights. We do not use sensitive personal information for advertising, profiling, or to infer characteristics about you beyond what is necessary to deliver the features you use.

How We Use Information

We use the information we collect to:

  • Provide, operate, and improve the Services
  • Generate sleep insights, reports, scores, trends, and notifications
  • Personalize recommendations and app experiences
  • Maintain account security, prevent fraud, and troubleshoot technical issues
  • Respond to support requests and communicate service updates
  • Comply with legal obligations and enforce our Terms

How We Share Information

We do not sell your personal information, and we do not share your personal information for cross-context behavioral advertising.

We may share limited information with:

  • Service providers (cloud hosting, analytics, customer support, payment processing, email delivery) under contractual obligations to protect your data and use it only for the purposes we specify
  • Legal and safety purposes, including when required by law, subpoena, or court order, or to protect the rights, property, or safety of OZI Sleep, our users, or others
  • Business transfers, in connection with a merger, acquisition, financing, or sale of assets, subject to standard confidentiality protections

Data Security

We implement administrative, technical, and physical safeguards designed to protect your information, including encryption in transit, access controls, and monitoring. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

International Data Transfers

OZI Sleep is operated from the United States. If you access the Services from outside the U.S., your information may be transferred to, stored, and processed in the United States or other countries where our service providers operate. By using the Services, you consent to such transfers.

Data Retention

We retain personal information only as long as necessary to provide the Services and for the purposes described in this policy. Specifically:

  • Account information: retained while your account is active, and deleted within [90] days after account deletion
  • Sleep and health data: retained while your account is active; you may delete individual records at any time within the app
  • Support communications: retained for up to [2] years for quality and training purposes
  • Legal and compliance records: retained as required by law (tax, warranty, fraud prevention)

Your Privacy Rights

Depending on where you live, you may have the following rights:

  • Right to know what personal information we collect, use, and share
  • Right to access and receive a copy of your personal information
  • Right to correct inaccurate personal information
  • Right to delete your personal information
  • Right to opt out of the sale or sharing of personal information (we do not sell or share)
  • Right to limit the use of sensitive personal information
  • Right to non-discrimination for exercising your privacy rights
  • Right to data portability (where applicable)

To exercise these rights, contact us at service@ozisleep.com. We will verify your identity before processing requests. You may authorize an agent to act on your behalf in accordance with applicable law.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of material changes through the app, by email, or by other reasonable means. Your continued use of the Services after the effective date constitutes acceptance of the updated policy.

Terms of Use

By downloading, accessing, or using OZI Sleep, you agree to these Terms of Use (“Terms”). If you do not agree, do not use the Services.

Eligibility

You must be at least 13 years old to create an account. Users between 13 and 18 must have permission from a parent or legal guardian. Parents or legal guardians may create profiles for children under 13 with verifiable parental consent (see Children’s Privacy below).

Acceptable Use

You agree to use OZI Sleep only for lawful purposes and in accordance with these Terms. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree not to:

  • Use the Services in any way that could damage, disable, overburden, or impair the Services
  • Attempt to access data or accounts belonging to other users
  • Reverse engineer, decompile, copy, modify, or interfere with the hardware, firmware, software, or app
  • Use OZI Sleep for unlawful, abusive, harassing, or fraudulent purposes
  • Misrepresent sleep data, identity, or household relationships
  • Use automated systems (bots, scrapers) to access the Services

OZI Sleep may suspend or terminate access at any time if we reasonably believe a user has violated these Terms.

Intellectual Property

All content, trademarks, logos, software, and materials provided through OZI Sleep are owned by OZI Sleep or its licensors and are protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes.

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the app or by email. Continued use of the Services after changes constitutes acceptance.

Termination

You may stop using OZI Sleep and delete your account at any time. We may suspend or terminate your access for violations of these Terms or at our discretion with reasonable notice.

Wellness & Medical Disclaimer

OZI Sleep is intended for general wellness and lifestyle purposes only. OZI Sleep is not a medical device and is not intended to diagnose, treat, cure, monitor, or prevent any disease or medical condition. OZI Sleep has not been evaluated by the U.S. Food and Drug Administration (FDA).

Sleep scores, sleep stages, heart rate, heart rate variability, breathing rate, movement, snoring, alerts, readiness scores, and other information provided by OZI Sleep are estimates only and may not always be accurate or complete.

The information provided by OZI Sleep should not be used as a substitute for professional medical advice, diagnosis, or treatment. If you have concerns about your health, sleep, breathing, heart rate, or any medical condition, consult a qualified healthcare professional. Do not disregard professional medical advice or delay seeking treatment because of information provided by OZI Sleep.

Alerts & Accuracy Disclaimer

Alerts and notifications are designed to provide additional awareness only.

Out-of-bed alerts, abnormal heart rate alerts, breathing alerts, sleep disturbance alerts, and other notifications may be delayed, inaccurate, unavailable, or incomplete due to internet connectivity, WiFi or Bluetooth issues, device placement, hardware or software limitations, user movement, environmental conditions, or other factors outside our control.

OZI Sleep must not be relied upon for emergency monitoring, infant monitoring, medical monitoring, life-support purposes, or any situation where delayed or inaccurate information could result in injury, illness, or death.

Users remain solely responsible for supervising children, older adults, and individuals with medical conditions.

Children’s Privacy

OZI Sleep is not directed to children under 13, and we do not knowingly collect personal information directly from children under 13 without verifiable parental consent.

Parents or legal guardians must provide verifiable consent before creating a profile or submitting personal information for a child under 13. We obtain consent through [describe method, e.g., “a confirmation email sent to the parent’s verified email address and acknowledgment within the app”].

Parents or guardians may at any time:

  • Review the personal information collected about their child
  • Request correction or deletion of their child’s information
  • Refuse further collection or use of their child’s information
  • Revoke consent previously provided

OZI Sleep is not intended for use with infants or very young children. The OZI Sleep Tracker is not a baby monitor and does not monitor for breathing irregularities, sleep disturbances, or medical emergencies in infants.

Data Retention & Deletion

You may request deletion of your account or personal information at any time. Within the app, you may:

  • Delete individual sleep records
  • Delete individual profiles
  • Remove household members
  • Delete your account
  • Request permanent deletion of stored data

We may retain certain information after deletion for legal, security, fraud prevention, tax, warranty, or compliance purposes where permitted or required by law.

Device Safety & Wireless Compliance

Safety Instructions

  • Use only the included charger and cable with your OZI Sleep Tracker
  • Do not use the product with damaged cords or cables
  • Keep the tracker and charger away from water and liquids
  • Keep all cords, cables, and small parts away from infants and young children
  • Do not allow children to play with the cable, charger, or tracker

FCC Compliance

The OZI Sleep Tracker complies with Part 15 of the FCC Rules. Operation is subject to the following two conditions:

  1. This device may not cause harmful interference.
  2. This device must accept any interference received, including interference that may cause undesired operation.

Changes or modifications not expressly approved by OZI Sleep may void the user’s authority to operate the device.

California Proposition 65 Notice

WARNING: This product can expose you to chemicals known to the State of California to cause cancer or reproductive harm. For more information, visit www.P65Warnings.ca.gov.

Warranty

OZI Sleep warrants the OZI Sleep Tracker against defects in materials and workmanship under normal use for one (1) year from the date of original purchase by the original end user.

This warranty does not cover:

  • Misuse, accidents, abuse, or neglect
  • Unauthorized modifications or repairs
  • Improper installation or operation
  • Water damage or exposure to liquids
  • Normal wear and tear, including cosmetic damage
  • Damage caused by failure to follow product instructions
  • Products purchased from unauthorized resellers

To make a warranty claim, contact service@ozisleep.com with proof of purchase, a description of the defect, and photos if applicable. We will provide return instructions and, at our option, repair, replace, or refund the defective product.

To the extent permitted by law, all implied warranties, including merchantability and fitness for a particular purpose, are limited to the duration of this express warranty. Some states do not allow limitations on implied warranties, so these limitations may not apply to you.

Limitation of Liability

To the fullest extent permitted by law, OZI Sleep and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, data, use, or goodwill, arising from or related to the use or inability to use the product or services, even if advised of the possibility of such damages.

In no event shall OZI Sleep’s total liability exceed the amount you paid for the product or services in the twelve (12) months preceding the claim.

Some states do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you.

Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of [California], United States, without regard to conflict of laws principles.

Binding Arbitration. Any dispute, claim, or controversy arising from or relating to these Terms or the Services shall be resolved through final and binding arbitration administered by [JAMS / AAA] under its applicable rules, in [County, State], except that either party may bring an individual action in small claims court.

Class Action Waiver. You and OZI Sleep agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

You may opt out of this arbitration agreement by sending written notice to service@ozisleep.com within 30 days of first accepting these Terms.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and OZI Sleep regarding the Services and supersede any prior agreements.
